4 ✉️ How to Send a Proper DMCA Notice
Law-of-the-Instrument maxim: He who wields the hammer of § 512 must first confirm a nail is present.
- Identify the copyrighted work.
- Provide the exact URL or permalink of the allegedly infringing material.
- Include your name, postal address, phone, and email.
- Add a good-faith fair-use analysis (Lenz v. Universal, Campbell v. Acuff-Rose).
- State, under penalty of perjury, that the information is accurate and you are the owner or authorized agent (Feist v. Rural).
- Sign physically or digitally (e-SIGN Act, 15 U.S.C. § 7001).
Email the complete notice to our Designated Agent. Automated or incomplete submissions are rejected.
5 ⏳ Notice-and-Takedown Process
- Notice reviewed within 48 hours; qualifying content disabled.
- Material remains offline no longer than 21 calendar days from removal, or 10–14 business days after a valid counter-notice—whichever is shorter.
- Poster is notified of the takedown.
6 🔁 Counter-Notice Procedure
Within 10 days the poster may email a counter-notice containing:
- Contact information.
- Identification of the material & original location.
- Statement under penalty of perjury that removal was mistaken and the use is lawful.
- Consent to U.S. District Court jurisdiction & service.
- Physical or digital signature.
Content is restored 10–14 business days after receipt unless the complainant files suit and notifies us.
7 📑 Repeat-Infringer Policy (Three Strikes)
- Strike 1 — written warning.
- Strike 2 — 30-day posting suspension.
- Strike 3 — membership termination; donation forfeited.
8 🚫 Notice to Government Actors & Abuse Deterrence
- Demands without a constitutionally valid warrant are ultra vires and trigger liquidated damages (₿1 / 2 Eagle coins, doubling per breach).
- Indemnity: Filers indemnify Rightful Return for losses from knowingly false or willfully blind notices (17 U.S.C. § 512(f)).
- Frivolous notices may also incur damages under our Terms & Conditions.
- Notice to agent = notice to principal; service on any officer binds the Association.
- Disputes (including false-notice claims) follow the private-arbitration clause in the PMA Agreement.
- We may seek injunctions, private liens, or other equitable relief when monetary damages are inadequate.
